{"id":20590,"date":"2020-12-10T12:29:24","date_gmt":"2020-12-10T12:29:24","guid":{"rendered":"https:\/\/smh.group\/?p=20590"},"modified":"2020-12-10T12:29:24","modified_gmt":"2020-12-10T12:29:24","slug":"capital-gains-tax-increases-on-the-way","status":"publish","type":"post","link":"https:\/\/devstagesite.co.uk\/smhgroup\/capital-gains-tax-increases-on-the-way\/","title":{"rendered":"Capital gains tax: increases on the way?"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\"><strong>A recent report could herald changes to capital gains tax.<\/strong><\/h3>\n\n\n\n<p>Last July the Chancellor asked the Office of Tax Simplification (OTS) to undertake a review of <strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/devstagesite.co.uk\/smhgroup\/chartered-accountants\/taxation\/capital-gains-tax\/\">capital gains tax<\/a><\/span><\/strong> (CGT) \u201cin relation to individuals and smaller companies\u201d. The request was something of a surprise for two reasons. Firstly, there had been no suggestion that Mr Sunak wanted to reform capital gains tax. Secondly, two earlier reports on another capital tax, inheritance tax, had been sitting in the Treasury\u2019s in-tray for over a year, awaiting attention.<\/p>\n\n\n\n<p>Cynics pointed out that while the Conservatives\u2019 2019 manifesto promised no increases to the rates of income tax, VAT and national insurance, there was no such protection for CGT. Certainly, the ideas put forward by the OTS would raise extra revenue for the Treasury\u2019s depleted coffers, but probably not the \u00a314bn seen in some of the November headlines.<\/p>\n\n\n\n<p><strong>The OTS made eleven proposals for the government to consider. The more significant were:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>CGT rates should be more closely aligned with income tax rates, implying the maximum tax rate on most gains could rise from 20% to 45%.<\/li><li>The annual exempt amount, currently \u00a312,300 of gains, should be reduced to a \u2018true de minimis level\u2019 of between \u00a32,000 and \u00a34,000.<\/li><\/ul>\n\n\n\n<p>When inheritance tax relief applies to an asset, there should be no automatic resetting of CGT base values at death, as currently occurs. The OTS also suggested that the government should consider whether to end<em> all <\/em>rebasing at death, meaning that the person inheriting an asset would be treated as acquiring it at the base cost of the person who has died.<\/p>\n\n\n\n<p>The \u00a31m Business Asset Disposal Relief, which only replaced the \u00a310m Entrepreneurs\u2019 Relief in March 2020, should itself be replaced with a new relief more focused on retirement.<\/p>\n\n\n\n<p>The OTS paper underlines just how favourably capital gains are currently treated relative to income.
