{"id":20076,"date":"2020-04-22T13:41:42","date_gmt":"2020-04-22T13:41:42","guid":{"rendered":"https:\/\/smh.group\/?p=20076"},"modified":"2023-02-15T13:49:39","modified_gmt":"2023-02-15T13:49:39","slug":"covid-19-measures-for-business-22-april-2020","status":"publish","type":"post","link":"https:\/\/devstagesite.co.uk\/smhgroup\/covid-19-measures-for-business-22-april-2020\/","title":{"rendered":"Covid-19 measures for business &#8211; 22 April 2020"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\"><strong>Coronavirus Job Retention <a href=\"https:\/\/www.gov.uk\/guidance\/claim-for-wage-costs-through-the-coronavirus-job-retention-scheme\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Scheme<\/a> (<a>CJRS<\/a>) <\/strong><\/h3>\n\n\n\n<p>Some form of job support scheme had been expected after the\n17 March announcement and the CJRS is similar to schemes that have already been\nset up elsewhere in Europe. Under the CJRS, \u201cHMRC will reimburse 80% of a furloughed\nworker\u2019s wage costs, up to a cap of \u00a32,500 per month\u2019, provided the worker was\non the employer\u2019s PAYE payroll on or before 19\nMarch 2020 and was notified to HMRC on an RTI submission by that date. The cut-off\ndate was originally announced as 28 February but was changed to 19 March (the\nday before the Chancellor announced the CJRS) on 15 April. <\/p>\n\n\n\n<p>The time frame for the CJRS was extended to\nthe end of June on 17 April, with the scheme opening to applications from 20\nApril.<\/p>\n\n\n\n<p>In this context \u2018furloughed workers\u2019 are non-working\nemployees (including part timers and employees on agency, flexible or zero\nhours contracts) who are kept on the payroll, rather than being laid off. The employee must be furloughed for at least three\nconsecutive weeks. The employer has to designate these employees and\nsubmit relevant information to HMRC via a \u201cnew online portal\u201d available \u201cby the end of April\u201d. The HMRC payments\nwill cover 80% of \u201cusual monthly wages\u201d plus the associated Employer National\nInsurance contributions and minimum automatic enrolment employer pension\ncontributions on that wage. <\/p>\n\n\n\n<p><strong>NEW ANNOUNCEMENT<\/strong><\/p>\n\n\n\n<p>Employees who left or were made\nredundant after 28 February can be re-employed and\nplaced on furlough, with the (former) employer then claiming under the CJRS for\ntheir wages through the scheme. This applies even if re-employment does not\nstart until after 19 March.<\/p>\n\n\n\n<p>The CJRS is available to one person companies whose director\/owner\nfurloughs themselves. However, only salary is covered, not dividends, and like\nall other furloughed workers, the director \u201ccannot undertake work for or on\nbehalf of the organisation\u201d. According to press reports the Treasury\nnevertheless accepts that the director may continue with their statutory\nobligations in that role. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/www.gov.uk\/government\/publications\/guidance-to-employers-and-businesses-about-covid-19\/covid-19-support-for-businesses#support-for-businesses-who-are-paying-sick-pay-to-employees\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Statutory sick pay (SSP)<\/a><\/strong> <\/h3>\n\n\n\n<p>Businesses with fewer than 250 employees as at 28\nFebruary 2020 will be refunded the full cost of providing SSP to any employee\noff work for up to 14 days because of coronavirus.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Loan guarantees<\/strong> <\/h3>\n\n\n\n<p>A government-backed loan guarantee scheme announced in\nthe Budget has since been regularly extended and enhanced. The Government will\nnow provide loan guarantees up to \u201can initial\u201d \u00a3330 billion for <em>all <\/em>sizes\nof businesses. In all instances businesses remain responsible for repaying any\nfacility they may takeout \u2013 any guarantees are for the lender:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>For large firms (with more than \u00a34 5million turnover)<\/strong>, the Bank of England has launched a <strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.bankofengland.co.uk\/news\/2020\/march\/hmt-and-boe-launch-a-covid-corporate-financing-facility\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Covid Corporate Financing Facility (opens in a new tab)\">Covid Corporate Financing Facility<\/a><\/span><\/strong> (CCFF), which \u201cwill provide funding to businesses by purchasing commercial paper of up to one-year maturity, issued by firms making a material contribution to the UK economy\u201d. The company must satisfy Bank of England lending criteria, which originally meant having an investment grade credit rating from a ratings agency but has since been changed to also allow lending banks to judge credit worthiness. However, the ultimate decision remains with the Bank of England. As at 3 April, about \u00a33.5 billion had either been provided or committed.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>\u00a0For medium sized businesses (turnover between \u00a345 million and \u00a3500 million)\u00a0 <\/strong>On 3 April the Chancellor announced the <strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.gov.uk\/government\/publications\/guidance-to-employers-and-businesses-about-covid-19\/covid-19-support-for-businesses#support-for-large-businesses-through-the-coronavirus-large-business-interruption-loan-scheme\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Coronavirus Large Business Interruption Loan Scheme (opens in a new tab)\">Coronavirus Large Business Interruption Loan Scheme<\/a><\/span><\/strong> (CLBILS). The scheme is due to launch later in April and will fill a finance gap that had emerged between the two existing loan support schemes. The CLBILS will have a loan ceiling of \u00a325 million and is targeted at businesses that are too large for the CBILS (see below) but fail to meet the criteria for the CCFF. The new scheme will provide a government guarantee of 80% on individual loans and other forms of finance (e.g. overdrafts) for businesses. <\/li><\/ul>\n\n\n\n<p>The aim is to provide support for businesses that were viable before the\nCovid-19 pandemic but now face significant cash flow difficulties that would\notherwise make their business unviable in the short term. Lenders will be\nexpected to conduct their usual credit risk checks and charge\ncommercial rates of interest.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>For small and medium sized businesses (turnover up to \u00a345m)<\/strong> The loan limit on the <strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.gov.uk\/guidance\/apply-for-the-coronavirus-business-interruption-loan-scheme\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Coronavirus Business Interruption Loan Scheme (opens in a new tab)\">Coronavirus Business Interruption Loan Scheme<\/a><\/span><\/strong> (CBILS) is \u00a35 million (originally \u00a31.2 million), with no interest charged for the first twelve months and lender-levied fees will be covered. The scheme is delivered through 40 accredited commercial lenders, backed by the <strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.british-business-bank.co.uk\/ourpartners\/coronavirus-business-interruption-loan-scheme-cbils-2\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"British Business Bank (opens in a new tab)\">British Business Bank<\/a><\/span><\/strong>. Eligible SMEs must be UK-based and meet \u201cthe other British Business Bank eligibility criteria\u201d. The government has made clear that this now means the CBILS is available to all SME businesses affected by Covid-19 and not just those unable to secure regular commercial financing elsewhere. \u00a0Lenders cannot require personal guarantees on borrowing of under \u00a3250,000, nor can primary residential property be taken as security under the scheme. When a personal guarantee is required, it is capped at 20% of the outstanding value of the loan. As at <br> 15 April, the CBILS had provided \u00a31.1 billion of loans to just over 6,000 businesses. Applications received had reached nearly 28,500, although inquiries had exceeded 300,000.<\/li><\/ul>\n\n\n\n<p><strong>NEW<\/strong> <strong>ANNOUNCEMENT<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/www.gov.uk\/government\/news\/billion-pound-support-package-for-innovative-firms-hit-by-coronavirus\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Support package for innovative firms<\/a><\/strong><\/h3>\n\n\n\n<p>On 20 April the Chancellor announced a two-part\nsupport package for \u2018innovative firms\u2019, which means mainly start-ups and other\nventure capital backed business that would be unable to raise CBLIS or CLBILS\nfinance.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong><a href=\"https:\/\/www.gov.uk\/guidance\/future-fund\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">The Future Fund<\/a> <\/strong>will launch in May and be delivered with the <a href=\"https:\/\/www.british-business-bank.co.uk\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\"><strong><span style=\"text-decoration: underline;\">British Business Bank<\/span><\/strong><\/a>. The fund will provide loans between \u00a3125,000 and \u00a35 million, with private investors at least matching the government commitment. These loans will automatically convert into equity on the company\u2019s next qualifying funding round, or at the end of the loan if they are not repaid. <\/li><\/ul>\n\n\n\n<p>To be\neligible, a business must be an unlisted, UK registered and UK based company\nthat has previously raised at least \u00a3250,000 in equity investment from third\nparty investors in the last five years. To begin with the government is\ncommitting <br>\n\u00a3250 million to the scheme. It will initially be open until the end of\nSeptember, with its scale kept under review.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Targeted Support for Research and Development (R&amp;D) <\/strong>\u00a3750 million of targeted support for the most R&amp;D intensive small and medium size firms will be made available through a grants and loan scheme operated by <a href=\"https:\/\/www.gov.uk\/government\/organisations\/innovate-uk\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\"><strong><span style=\"text-decoration: underline;\">Innovate UK<\/span><\/strong><\/a>, the national innovation agency. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Innovate UK will accelerate up to \u00a3200 million\nof grant and loan payments for its 2,500 existing customers on an opt-in basis.\nAn extra \u00a3550 million will also be made available to increase support for\nexisting customers and \u00a3175,000 of support will be offered to around 1,200\nfirms not currently in receipt of Innovate UK funding. The first payments will\nbe made by mid-May.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Deferral of <a href=\"https:\/\/www.gov.uk\/guidance\/deferral-of-vat-payments-due-to-coronavirus-covid-19\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">VAT<\/a> and <a href=\"https:\/\/www.gov.uk\/pay-self-assessment-tax-bill\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Income Tax<\/a> Payments \u00a0<\/strong><\/h3>\n\n\n\n<p>For the period between 20\nMarch 2020 and 30 June 2020, businesses will not be required to make a VAT\npayment. Instead they will be able to defer this payment until the end of the\n2020\/21. VAT refunds and reclaims will be paid by the government as normal. No\napplications will be required as the process will be automatic. <\/p>\n\n\n\n<p>Self assessment income tax payments due on the 31 July\n2020 (the second payment on account for 2019\/20) will be deferred until the 31\nJanuary 2021. This also will not require an application and is <em>not<\/em>\nlimited to just the self-employed, although the Treasury says \u201cIf you are still\nable to pay your second payment on account on 31 July you should do so\u201d. Penalties\nand interest for late payment will not be charged in the deferral period. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/www.gov.uk\/government\/publications\/guidance-to-employers-and-businesses-about-covid-19\/covid-19-support-for-businesses#support-for-retail-hospitality-and-leisure-businesses-that-pay-business-rates\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Business Rates Retail Discount<\/a>\u00a0 <\/strong><\/h3>\n\n\n\n<p><em>All<\/em> shops, cinemas,\nrestaurants, music venues and business operating in the leisure and hospitality\nsectors will have <strong>no<\/strong> business rates to pay in 2020\/21. <br><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/878082\/small-business-grant-and-retail-leisure-hospitality-grant-guidance-for-businesses-v2.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Grant Funding Schemes<\/a><\/strong><\/h3>\n\n\n\n<p>There are two grant schemes based on rateable values:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><em>Small Business Grant\nFund<\/em> All eligible businesses in England in receipt of\neither Small Business Rates Relief (SBRR) or Rural Rates Relief (RRR) in the business\nrates system will be eligible for a payment of \u00a310,000.<\/li><li><em>Retail, Hospitality and Leisure Grant Eligibility<\/em> All eligible\nbusinesses in England in receipt of the Expanded Retail Discount (which covers\nretail, hospitality and leisure) with a rateable value of up to than \u00a315,000\nwill be eligible for a cash grants of \u00a310,000 per property and those with a rateable\nvalue of more than \u00a315,000 but less than \u00a351,000 will be eligible for a cash\ngrant of \u00a325,000 per property.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/877772\/Nursery_discount_guidance_April_2020.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Nursery businesses that pay business rates<\/a><\/strong><\/h3>\n\n\n\n<p>For nursery school businesses based in England,\nthere will be a business rates holiday for 2020\/21. The nursery property must be:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>occupied by\nproviders on Ofsted\u2019s Early Years Register<\/li><li>wholly or mainly\nused for the provision of the Early Years Foundation Stage.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/www.gov.uk\/government\/publications\/guidance-to-employers-and-businesses-about-covid-19\/covid-19-support-for-businesses#commercial-insurance\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Commercial insurance<\/a> <\/strong><\/h3>\n\n\n\n<p>The question of the extent to which any insurance policy provides cover for the Covid-19 outbreak has proved contentious. Pandemic cover is not a feature of most business disruption cover, a point underlined by the Association of British Insurers (ABI) in a <strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.abi.org.uk\/news\/news-articles\/2020\/03\/statement-on-business-insurance-and-coronavirus\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"statement (opens in a new tab)\">statement<\/a><\/span><\/strong> it issued on 17 March. The ABI has since launched an information <strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.abi.org.uk\/products-and-issues\/topics-and-issues\/coronavirus-hub\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"hub (opens in a new tab)\">hub<\/a><\/span><\/strong> dealing with the impact of the virus on a range of insurance policies, from trade credit to private health. <\/p>\n\n\n\n<p><strong>NEW<\/strong> <strong>ANNOUNCEMENT<\/strong><\/p>\n\n\n\n<p>On 15 April the Financial Conduct Authority (FCA) issued a \u2018Dear CEO\u2019 letter to insurers, setting out its expectations of regulated firms and a reminder that for some SMEs, complaints will fall within the remit of the <strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.financial-ombudsman.org.uk\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Financial Ombudsman Service (opens in a new tab)\">Financial Ombudsman Service<\/a><\/span><\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Off-payroll working in the private sector (IR35)<\/strong> <\/h3>\n\n\n\n<p>On 17 March, the Chief Secretary to the Treasury,\nSteve Barker, said in a statement to the House of Commons that the start date\nfor the new IR35 tax rules would be deferred to <br>\n6 April 2021. <em><\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/www.gov.uk\/difficulties-paying-hmrc\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Time to Pay (TTP)<\/a><\/strong><\/h3>\n\n\n\n<p>In the Budget, the Chancellor announced that HMRC would\nscale up its Time to Pay service, giving businesses and the self-employed the\nchance to defer tax payments.<br><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/www.gov.uk\/government\/news\/extra-protection-for-businesses-with-ban-on-evictions-for-commercial-tenants-who-miss-rent-payments\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Protection from property forfeiture<\/a><\/strong><\/h3>\n\n\n\n<p>Commercial tenants who cannot pay their rent because of\nCOVID-19 are protected from forfeiture of their business property if they miss\na payment up until 30 June 2020. Reports suggest\nthat only 40% of the commercial property rents due on Lady Day (25 March) were\npaid on time. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Going concern<\/strong><\/h3>\n\n\n\n<p>The Financial Reporting Council (FRC) has issued financial <strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.frc.org.uk\/about-the-frc\/covid-19\/covid19-joint-statement-26th-march-2020\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"guidance (opens in a new tab)\">guidance<\/a><\/span><\/strong> in conjunction with the Financial Conduct Authority (FCA) and Prudential Regulatory Authority. This includes extensive <strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.frc.org.uk\/about-the-frc\/covid-19\/covid-19-bulletin-march-2020\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"information (opens in a new tab)\">information<\/a><\/span><\/strong> for auditors covering areas such as how to deal the question of whether a business is a going concern.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/protect-eu.mimecast.com\/s\/xpQyCwVY0HLlnjKHVQTF0?domain=gov.uk\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Wrongful Trading and business restructuring<\/a><\/strong><\/h3>\n\n\n\n<p>On 28 March the UK Business secretary announced changes to\ninsolvency&nbsp;law &#8220;to enable UK companies\nundergoing a rescue or restructure process to continue trading, giving them\nbreathing space that could help them avoid insolvency&#8221;.<\/p>\n\n\n\n<p>The wrongful trading law is being temporarily\nsuspended, retrospective from 1 March 2020. for three months. This gives\ncompany directors the ability to keep their businesses in being without risking\npersonal liability.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Coronavirus\nAct<\/h3>\n\n\n\n<p>The day before the Chancellor\u2019s latest statement, the <strong><span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.legislation.gov.uk\/ukpga\/2020\/7\/contents\/enacted\/data.htm\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Coronavirus Act 2020 (opens in a new tab)\">Coronavirus Act 2020<\/a><\/span><\/strong> received Royal Assent.
