{"id":19940,"date":"2020-02-13T12:45:00","date_gmt":"2020-02-13T12:45:00","guid":{"rendered":"https:\/\/smh.group\/?p=19940"},"modified":"2023-02-15T13:39:14","modified_gmt":"2023-02-15T13:39:14","slug":"intestacy-rule-change-favours-spouses","status":"publish","type":"post","link":"https:\/\/devstagesite.co.uk\/smhgroup\/intestacy-rule-change-favours-spouses\/","title":{"rendered":"Intestacy rule change favours spouses"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\"><strong>The intestacy rules for England and Wales\nhave been amended. <\/strong><\/h3>\n\n\n\n<p>The <strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/devstagesite.co.uk\/smhgroup\/wills-probate\/wills-trusts-estate-planning\/intestacy\/\">intestacy rules<\/a><\/span><\/strong> automatically apply to the distribution of estates where there is no valid will. There are three different sets of rules in the UK: one for England and Wales, a similar set for Northern Ireland and a much more different set for Scotland. <\/p>\n\n\n\n<p>The rules for England and Wales have just received a slight modification,\nwith the change made highlighting an aspect of intestacy of which many people are\nunaware: a surviving spouse or civil partner does not always inherit all of\ntheir deceased husband, wife or civil partner\u2019s estate. <\/p>\n\n\n\n<p>Up until 5 February 2020, the English and Welsh rules said that if the husband,\nwife or civil partner of the deceased survives 28 days, and the deceased had\nissue (broadly, children and their lineal descendants), then:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>The surviving spouse would receive:<\/strong><ul><li><strong>The personal chattels of the deceased (car, clothing, jewellery, etc);<\/strong><\/li><\/ul><ul><li><strong>\u00a3250,000 outright; and<\/strong><\/li><\/ul><ul><li><strong>One half of the residue of the estate.<\/strong><\/li><\/ul><\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>The issue would receive the other half of the residue.<\/strong><\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">From 6 February 2020, the \u00a3250,000 figure was increased\u2026to \u00a3270,000.<\/h3>\n\n\n\n<p>Adding \u00a320,000 to the outright inheritance does little to solve a problem\nthat some families potentially face in dealing with the family home. <\/p>\n\n\n\n<p>If the property is not owned in joint names (as joint tenants), then a\nsurvivor may not inherit the family home outright. In some cases, intestacy can\neven mean that there is an inheritance tax bill to meet on first death,\nsomething most estate planning aims to avoid.<\/p>\n\n\n\n<p>One other important fact to note about intestacy is that it deals only\nwith&nbsp; married spouses and civil partners\nand relations. If you live as a couple but are not married or in a civil\npartnership, intestacy could leave the survivor with nothing.<\/p>\n\n\n\n<p>The message is clear: if you have not made a <strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/devstagesite.co.uk\/smhgroup\/wills-probate\/wills-trusts-estate-planning\/will-writing\/\">will<\/a><\/span><\/strong>, make one.
